Will YouTube Fall Under the Safe Harbor?

One of the hottest lawsuits at the moment is the Viacom –YouTube/Google dispute. If you like reading motions and memorandum and if you want to familiarize yourself with the legal implications of the case, you can download the original documents from the parties on the New York Times’ website HERE.

The main issue yet to be decided by the US District Court for the Southern District of New York is to what extent YouTube can be considered a service provider under section 512(c) (safe harbour for hosting).
