US Fair Use, War Memorial and Photograph
We learned about an interesting US case about derivative works and fair use. Frank Gaylord, an 85 year old sculptor, won in 1990 a government-sponsored contest to sculpt a memorial to Korean War veterans (see it HERE) in Washington, D.C. The memorial was photographed by an amateur photographer, Alli in 1995. In 2002, the federal government paid Alli $1,500 to use his photo as the basis for a 37-cent postage stamp (see stamp HERE).
