Trademarks, Internet and Extraterritorial Jurisdictional Issues
An interesting conflict between trademarks registered in different countries and connected jurisdiction issues arose before US courts. The plaintiff was Gallup, Inc. (“Gallup”), the well-known U.S.-based market research and public opinion polling company that had been using the ‘Gallup’ trademark for its opinion poll services for over 70 years. The defendant was Gallup Pakistan, which had used a trade name ‘Gallup Pakistan’ for similar services for more than 30 years.
