The Public Domain Shrinks After Wizard of Oz Decision
111 years ago, in 1900, L. Frank Baum wrote the famous children's novel, "The Wonderful Wizard of Oz". The characters of Dorothy, the Scarecrow, the Cowardly Lion and the rest should therefore be part of the public domain. This case is about creating new private monopolies on public domain works and about the scope of the copyright created in these new derivative works or adaptations. The movie studio Warner Bros. owns the rights to the 1939 MGM movie, The Wizard of Oz, starring Judy Garland. Five years ago, Warner sued Avela, which specializes in nostalgia merchandise.
