Net Neutrality Slapped Down by the US Court of Appeals for the D.C. Circuit

The US Court of Appeals for the D.C. Circuit held unanimously this month (see decision HERE) that the US Federal Communications Commission (FCC) did not have the legal authority to issue a 2008 cease and desist order against the cable operator Comcast, which had taken measures to slow BitTorrent transfers. This decision clearly goes against the net neutrality policy that the FCC Chairman announced in October 2009.

The issue of jurisdictional authority of the FCC was indeed a major question regarding the FCC’s approach.
