Major ECJ Case: Google's Views Prevails over LVMH's

In a major decision for Google, the ECJ ruled that it can continue selling ads linked to searches for brand names.
This is extremely good news for Google who makes 97% of its revenues in advertising ($23 billion in 2009).

The French Cour de Cassation had to decide a lawsuit between the French luxury group LVMH and Google. LVMH complained that ads sold by Google infringed its trademarks and promoted the sale of counterfeit goods over the Internet. LVMH argued that links sold by Google under its ‘AdWords’ service and displayed alongside the search results on a Google page were bought by counterfeiters and constituted trademark infringement.
