IP Protection of Fashion in the US? No Clear Cut Solution
Kal Raustiala and Chris Sprigman, two law Professors respectively at UCLA and the University of Virginia discuss the Design Piracy Prohibition Act and make an interesting point on Freakonomics’ NY Times blog. Cheap “Red carpet copycats” (copies of the expensive dresses worn by the stars at the Oscars) are legal under current American copyright law. This may be explained by the hidden benefits of copying for the fashion industry, i.e. pushing it to change continuously and engage in “a ceaseless cycle of trends”.
