Recently, Paraguay has issued Law No. 3440/2008 that modifies our Criminal Code regarding the punishment for infringement of IP rights. According to the aforementioned law, any infringement and/or fraudulent imitation of a registered trademark or industrial model, will be punished with up to five years of imprisonment. In extremely severe cases (described by our law), i.e. involving people younger than 18 years old in the infringement process, the punishment may be up to 8 years of imprisonment. This law aims at strengtheing the anticounterfeiting campaing and will definitely contribute in creating awareness.
