Hitler Parody, DMCA and US Fair Use

Ars Technica reports that clips of a parody of the German movie Der Untergang (also known as Downfall) have been blocked by content owners on YouTube. The clips in question showed bunker scene from the movie, overlaid with new ‘geeky’ subtitles: Hitler getting upset about Twitter, the plot of Avatar, Kanye West running out on stage with Taylor Swift, or planning to upgrade from Windows XP to Windows 7, etc. Regardless of whether you would find this funny, there are arguments that the clips are parodies under the U.S. fair use exception.

The parody exception does not seem obvious here. It would imply that the work is sufficiently transformative to fall within the exception. [...]
