The End of US Gene Patenting ?

Another dramatic development regarding DNA and gene patenting took place in the US this week.

The shift came yesterday in a case between the American Civil Liberties Union (ACLU) and several scientific and patient advocacy groups against Myriad Genetics — which owns patents on two diagnostic tests that can contain mutations associated with breast cancer based on specific genes. Judge Robert Sweet, of the U.S. District Court of the Southern District of New York, invalidated the company’s patents, holding that they were “improperly granted” because they involve a “law of nature”, a classic exemption under patent law.
