Criminal sanctions under Copyright Act 1987 and Trade Descriptions Act 1972 to be tightened

Amendments to the Copyright Act 1987 are in the pipeline to further protect copyright owners by increasing controls over the purchase or ownership of pirated CDs, VCDs or DVDs and imposing stricter penalties against owners of premises trading in pirated goods.

In Malaysia, copyright infringement is actionable through civil proceedings, criminal sanctions and administrative measures.

Section 41(1) criminalises certain activities by classifying them as offences under the Act which are punishable by a fine or an imprisonment term or both, of such amount or duration depending on the type of activity.
