CJEU C-34/10 : stem cells based inventions are not patentable.

The European Court of Justice has issued today a long-awaited judgment in the Oliver Brüstle vs Greenpeace case.
The main issue for the court was whether human stem cells were patentable or not and further, whether this invention was unpatentable even though its purpose is not the use of human embryos, but it concerned a product whose production necessitates the prior destruction of human embryos.
On the basis of morality grounds, the CJEU ruled that they were not patentable, whatever the stage at which the destruction of embryos took place and even if the description of the technical teaching claimed does not refer to the use of human embryos.
