China: Harley-Davidson wins Groundbreaking Case Involving the Use of Unregistered Trademark
The Beijing Higher People's Court in a recent groundbreaking case involving the use of the unregistered trademark "Ha Lei in CC" (Harley in Chinese) held that the defendants, Chrome Horse and others, had infringed the trademark rights of Harley-Davidson and committed acts of unfair competition, including false advertisements. Chrome Horse operated retail stores but was not an authorized seller of Harley-Davidson merchandise. Harley-Davidson serves its Chinese customers through its authorized dealers in Beijing, Shanghai, Qingdao and Hong Kong.
