Notes of Dischord in 'Down Under' Song
Larrikin Music Publishing Pty Ltd v EMI Songs Australia Pty Ltd [2010] FCA 29: The Federal Court of Australia held that the 1981 hit song 'Down Under' by Men at Work infringed copyright in the well known 1934 Australian folk song, 'Kookaburra'. It was held that there was a resemblance or objective similarity between 'Kookaburra' and the flute riff in 'Down Under', and that a substantial part of 'Kookaburra' had been reproduced by 'Down Under'.
