Global IP Watch reports a High Court case of Ebay not jointly liable of infringement.

In this L’Oreal / E-Bay case, apart from an issue regarding the primary liability of the defendants who had listed the goods on E-Bay’s site, the High Court discussed whether Article 7(1) of the Trade Marks Directive, which ‘shall not entitle the proprietor of a trade mark to prohibit its use in relation to goods which have been put on the market in the Community’, provided a defence to infringing use in relation to testers and dramming products. “Dram” in the fragrance and cosmetics industry refers to measure: a unit of apothecaries' with a weight equal to 60 grains,or [...]
